Terms of Service

1. Acceptance of these terms
These Terms of Service (“Terms”) are a binding agreement between you (“you” or “Customer”) and Jaber AI, LLC (“Jaber AI,” “we,” or “us”), a New Mexico limited liability company. By accessing or using our websites and products at jaber.ai, ai.jaber.ai, and jaber.ai/edu (the “Services”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Accounts
You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. You must be at least the age of majority in your jurisdiction, or have permission of a parent, guardian, or the organization you represent, to enter into these Terms.
3. The Services
Jaber AI provides AI chatbots, enterprise AI applications, and related tools. We may add, change, or remove features, and we may set reasonable usage limits (such as message quotas) that vary by plan. We aim for high availability but do not guarantee uninterrupted service.
4. Plans & billing
Paid plans are billed in advance on a monthly or annual basis in U.S. dollars through our payment processor. Prices are shown on our pricing page and may change with notice. You authorize us to charge your payment method for all fees, applicable taxes, and any overage on your plan’s limits.
5. Trials, renewals & refunds
- Free trials convert to a paid plan at the end of the trial unless you cancel beforehand.
- Renewals are automatic for the same term until you cancel. You can cancel anytime; access continues until the end of the paid period.
- Refunds — fees are generally non-refundable except where required by law. If you believe you were billed in error, contact [email protected] within 14 days and we’ll review it in good faith.
6. Your content
You retain all rights to the content you submit to the Services (“Customer Content”). You grant Jaber AI a limited license to host, process, and display Customer Content solely to provide and improve the Services for you. You are responsible for having the rights and permissions needed for the content you submit, and for ensuring it complies with applicable law and our Acceptable Use Policy.
7. Acceptable use
Your use of the Services must comply with our Acceptable Use Policy, which is incorporated into these Terms. We may suspend or terminate accounts that violate it.
8. Intellectual property
The Services, including our software, models, designs, logos, and content (excluding Customer Content), are owned by Jaber AI or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services under these Terms. You may not copy, reverse-engineer, resell, or create derivative works from the Services except as permitted by law.
9. Third-party services
The Services may integrate with third-party platforms (such as messaging channels, payment processors, and AI model providers). Your use of those services is governed by their terms, and we are not responsible for them.
10. AI output disclaimer
Our Services use artificial intelligence, which can produce inaccurate or unexpected output. You are responsible for reviewing AI-generated responses before relying on them, especially for legal, financial, medical, or other high-stakes decisions. Jaber AI does not warrant that AI output is accurate, complete, or fit for any particular purpose.
11. Disclaimer of warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, Jaber AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Services will not exceed the amount you paid to us in the twelve (12) months before the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Jaber AI and its members, officers, and employees from claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Services and cancel your plan at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Services in a way that risks harm to us or others. On termination, your right to use the Services ends; sections that by their nature should survive (such as IP, disclaimers, and liability) will survive.
15. Governing law & disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute, except where applicable law grants you the right to bring a claim elsewhere.
16. Changes to these terms
We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.
